DESIGN LAW JUST FOR DESIGNERS

Design Law is a long-term intellectual property strategy that uses patent, copyright, and trademark law to protect the appearance of 3D and certain 2D products throughout their commercial life.

Introducing the DESIGN LAW WORKSHOP, an interactive online course that gives designers the opportunity to explore this critical business tool.

Under the personal guidance of coach Flann Lippincott, you will design and take a Virtual Product and Brand through the Design Law journey from idea to market. These are the steps that you would use in your own business to ensure that you have every tool at your disposal to combat infringement, counterfeits, and unfair contracts.

You will apply design-specific copyright, trademark, trade dress, design patent, contract, and management principles to your Virtual Product and Brand. This will teach you how to protect your ideas, technical drawings and models, molds, prototypes, finished products, marketing materials, and business relationships. And since you will be coached by an attorney-educator, you will practice how to develop strong, respectful relationships with the attorneys that you use in your own venture.

After you cross the finish line of the DESIGN LAW WORKSHOP, you will know how to lower your risks and costs and increase revenue and peace of mind with every product launch.

I created Get Traction to help designers take control of their intellectual property assets, work more efficiently with their attorneys, earn the respect of business partners, and keep competitors at bay.

As a former CEO in product design, I learned firsthand the importance of legal understanding in protecting designs and maximizing revenue. After a costly oversight in a licensing agreement, I immersed myself in law, earning two degrees and specializing in intellectual property and contracts. I went on to help designers tap into the power of law and avoid the legal mistakes that I had made in my own business.

  • Design Law is for anyone in any industry who creates commercial products with a distinctive appearance. Military, medical, automotive, footwear, electronics, furniture, lighting, toys, sports equipment, sculpture … you name it, as long as the product design is distinctive, or novel, or original, there are overlapping intellectual property regimes that can provide multiple layers of design protection for the long term through a thoughtful design law strategy.

  • Only a handful of U.S. intellectual property (IP) attorneys know how to apply patent, copyright, and trademark law to a product design. This is because IP attorneys typically work in 2 silos: copyright/trademark or patent/trademark. They aren’t equipped to explain Design Law as a strategic approach to design protection.

    Design Law requires knowing the critical filing dates of all three fields of IP law, as well as how each field applies to product design. When (not if) a talented designer’s product becomes a worldwide home-run hit, it will be copied. Timely IP protection makes the difference between reaping the rewards or giving it all away.

  • Contracts are the lifeblood of business because they establish the rules and expectations of a commercial relationship. Designers who understand their contracts reduce the risk of making expensive mistakes such as giving away their IP forever, receiving nominal royalties due to a vague definition of “net sales,” or taking responsibility for the other party’s negligence. Ouch!

    The DESIGN LAW WORKSHOP introduces the fundamental contract terms that all designers - whether they wholesale, retail, or license their products - must know to ensure long and fruitful sales relationships.
